GOLETAS SCREEN CAPTURE LICENSE AGREEMENT Version: August 30, 2005 This End-User License Agreement (“EULA”) is a legal agreement between you (either an individual or a single entity) and Goletas software laboratory for the Goletas software that accompanies this EULA, which includes computer software and may include associated media, printed materials, “online” or electronic documentation, and Internet-based services (the “Software”). An amendment or addendum to this EULA may accompany the Software. YOU AGREE TO BE BOUND BY THE TERMS OF THIS EULA BY INSTALLING, COPYING, OR OTHERWISE USING THE SOFTWARE. IF YOU DO NOT AGREE, DO NOT INSTALL, COPY, OR USE THE SOFTWARE. Provided that you comply with all terms and conditions of this EULA, Goletas grants you a royalty-free license to make copies, distribute, and install the Software on an unlimited number of computers. 1. The Software is protected by copyright laws and international copyright treaties. Goletas or its suppliers own the title, copyright, and other intellectual property rights in the Software. THE SOFTWARE IS LICENSED, NOT SOLD. 2. YOU MAY NOT REVERSE ENGINEER, DECOMPILE, OR DISASSEMBLE THE SOFTWARE. 3. THE SOFTWEARE MUST BE DISTRIBUTED FREE OF CHARGE. Renting, leasing, selling, or otherwise distributing copies of the Software for commercial advantage is prohibited. 4. YOU MAY MAKE UNLIMITED COPIES AND DISTRIBUTE THE SOFTWARE ONLY IN ITS ORIGINAL UNMODIFIED PACKAGE. 5. You agree that Goletas and its affiliates may collect and use technical information gathered as part of the product support services provided to you, if any, related to the Software. Goletas may use this information solely to improve our products or to provide customized services or technologies to you and will not disclose this information in a form that personally identifies you. 6. Any unauthorized use shall result in immediate and automatic termination of this EULA, and may result in severe civil and criminal penalties, and will be prosecuted to the maximum extent possible under the law. 7. THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT OF THIRD PARTY RIGHTS. IN NO EVENT SHALL GOLETAS, THE CONTRIBUTORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE. 8. This EULA is effective until terminated. You may terminate the EULA at any time by destroying all copies of the Software. The EULA will terminate automatically, without notice from Goletas, if you fail to comply with this agreement. Upon such termination, you shall destroy all copies of the Software; otherwise, any use of the Software is subject to the terms and conditions of the EULA. http://www.goletas.com
